Our Conveyancing Process

Please note: The transfer process can take up to three (3) months, or longer, depending on the circumstances surrounding each matter.

There are different steps involved in the transfer of a property that include, but are not limited to, the following:

Instruction:

The Conveyancer receives the instruction to attend to the conveyancing of the property, either from an Estate Agent, Seller of Purchaser.

Communication:

The Conveyancer communicates with the various role-players involved in the transfer process, namely, Seller, Purchaser, Estate Agents, Bond Attorneys, Cancellation Attorneys, municipality, banks, South African Revenue Services (SARS), ect.

Collection of documents:

Certain information and documents are required by the Conveyancer, such as, the agreement of sale, a deeds office search on the property, the existing deed, bond cancellation figures from the bank, bond requirements from the attorneys dealing with the registration of the bond, FICA documents from the Seller and Purchaser ect.

Drafting and signing:

As soon as all the information and documents have been received, the Conveyancer will then draft the necessary transfer documents and call the Seller and Purchaser in to sign same, once they have been finalised.

Finances:

The Conveyancer will need to obtain the necessary finances relating to the transfer. Calling for deposits, purchase price, guarantees from the bank for the bond, the conveyancing fees in order to make the necessary disbursement payments and so on.

Transfer duty:

The Conveyancer will need to obtain a transfer duty receipt from SARS confirming that all tax relating to the transfer has been paid and is up to date.

Rates clearance certificates:

The Conveyancer will need to obtain a certificate from the municipality confirming that all utility amounts in respect of the property have been paid and is up to date for the past two years. Please note, due to the COVID – 19 lockdown, the rates department is experiencing a massive backlog and causing a huge delay in all transfers.

Compliance certificates:

The Conveyancer will need to have an electrical, entomology, gas (if applicable) and electric fence (if applicable) compliance certificates in respect of the property on file before lodgement.

Prep:

The Conveyancer prepares all the necessary documents for lodgement (submission) to the Deeds Office.

Registration:

Once the Deed of Transfer and the other required documents have been lodged, the Deeds Office takes about 10 working days to examine the documents. If the Deeds Office is satisfied that all the requirements for the transfer have been met, the deed of transfer will be registered. The Conveyancer will then be notified and can then notify the necessary role-players of the registration.

Accounts:

Once the transfer has been registered, the Conveyancer will make the necessary calculations and payments relating to the sale, for example, estate agents commission, purchase price, disbursements and so on. The Conveyancer will draw up a final account for the Seller and Purchaser and send same to the relevant parties.

Please note, the above steps are a simple guideline as to the transfer process. The transfer may not necessarily occur in the above order, and there may be more or less steps required, depending on the situation.
